1. Scope

This Cookie Policy explains how SwissHelios S.à.r.l. (“SwissHelios,” “we,” “us,” or “our”) uses cookies and similar technologies in connection with Engage366, including the website at https://engage366.ch, web interfaces, forms, booking experiences, and other online services that reference this policy (collectively, the “Services”).

This Cookie Policy should be read together with the Engage366 Privacy Policy. The Privacy Policy explains how SwissHelios collects, uses, discloses, stores, and otherwise processes personal data, including information collected through cookies and similar technologies.

2. What Cookies and Similar Technologies Are

Cookies are small text files that a website can store on a user’s device. Similar technologies may include local storage, session storage, pixels, tags, scripts, software development kits, or comparable browser and device storage or identification mechanisms.

These technologies can support essential website functions, remember preferences, help measure website performance, enable communication or booking features, and, where enabled and legally permitted, support analytics or marketing activities.

3. Categories of Technologies We May Use

The technologies used on Engage366 may vary depending on the features enabled on a particular page, account, campaign, or integration. We may use the following categories:

3.1 Strictly Necessary Technologies

These technologies are required for the Services to function securely and reliably. They may support functions such as security, session management, load balancing, form operation, fraud prevention, user authentication, or remembering a user’s privacy choices.

Where a technology is strictly necessary to provide a service expressly requested by the user or to ensure security and core functionality, it may operate without an optional consent choice, subject to applicable law.

3.2 Preference Technologies

Preference technologies remember choices that improve the user experience, such as language selection, display preferences, theme settings, or similar interface choices. Some preferences may be stored in browser local storage rather than in a traditional cookie.

3.3 Analytics and Performance Technologies

Where enabled, analytics and performance technologies help us understand how visitors use the Services, such as which pages are viewed, how users navigate, general device or browser information, error information, and aggregated usage patterns. We use this information to maintain and improve website performance and user experience.

Where applicable law requires consent for analytics or similar non-essential technologies, those technologies will be activated only after the required choice has been obtained.

3.4 Marketing and Advertising Technologies

Where enabled, marketing technologies may be used to measure campaign effectiveness, understand referral sources, create audiences, or support advertising activities. These technologies may be provided by third parties and may allow those providers to recognize a browser or device across different websites or services.

Where consent is legally required for marketing, advertising, profiling, or cross-site tracking technologies, we will request that consent before activating them.

3.5 Communication, Booking, and Embedded Content

Pages may include communication, scheduling, chat, video, map, social media, payment, or other embedded functionality. Providers of those features may place or access cookies or similar technologies when the feature is loaded or used. Where required, non-essential embedded technologies will be subject to the user’s privacy choices.

4. Legal Basis and Consent

SwissHelios processes personal data collected through cookies and similar technologies in accordance with applicable data protection and telecommunications requirements, including the Swiss Federal Act on Data Protection (nFADP) and, where applicable, the EU General Data Protection Regulation (GDPR) and UK GDPR.

Depending on the technology and jurisdiction, processing may be necessary to provide the requested service, may be based on legitimate interests, or may require consent. Where consent is required, users must be able to make a genuine choice regarding non-essential technologies and may withdraw that consent later.

5. Managing Cookie and Tracking Preferences

Where a cookie or privacy-preference interface is provided, users can use it to accept, reject, or adjust available categories of non-essential technologies. Strictly necessary technologies may remain active because the Services cannot operate correctly without them.

Users can also manage cookies through browser settings. Browser controls may allow users to block, delete, or limit cookies. Blocking certain technologies may affect website functionality, saved preferences, forms, login sessions, or embedded features.

Withdrawing or changing consent does not affect the lawfulness of processing that occurred before the preference was changed.

6. Third-Party Technologies and Service Providers

SwissHelios may use third-party service providers for functions such as hosting, security, payment processing, transactional email, SMS or telephony, analytics, scheduling, customer communication, and AI-enabled features. Depending on the feature, those providers may process technical identifiers or other information through cookies or similar technologies.

Third-party providers process data under their own terms and privacy notices where they act independently. Where a provider processes personal data on behalf of SwissHelios, SwissHelios uses contractual and organizational safeguards appropriate to the relationship.

7. International Data Transfers

As described in the Engage366 Privacy Policy, personal data may be processed in Switzerland, the European Economic Area (EEA), the United States, or other locations used by approved service providers. Where a transfer requires additional safeguards, SwissHelios applies appropriate legal mechanisms, which may include recognized adequacy mechanisms, applicable data privacy frameworks, or Standard Contractual Clauses adapted as required for Swiss or European data protection law.

8. Retention

The lifetime of a cookie or similar technology depends on its purpose. Session technologies may expire when the browser is closed, while persistent technologies may remain for a defined period or until deleted by the user.

SwissHelios seeks to retain identifiers and information collected through cookies only for as long as reasonably necessary for the relevant purpose, legal obligations, security, or documented business needs. Exact retention periods may differ by technology and provider.

9. Cookie and Similar-Technology Schedule

Because Engage366 is a configurable platform and its website features may change, the exact technologies used can differ over time. SwissHelios will maintain a current inventory through the applicable cookie-preference interface, technical documentation, or an updated schedule where appropriate.

Before publishing or materially expanding non-essential tracking on the Engage366 website, the deployed technologies should be verified so that specific provider names, purposes, and retention periods can be disclosed accurately.

10. Changes to this Cookie Policy

SwissHelios may update this Cookie Policy from time to time to reflect changes in technology, law, regulation, or the Services. The latest version will be made available through the Engage366 website with an updated revision date.
